Harrington Park, New Jersey (May 2, 2016) – On April 1, 2016, LIHI Executive Director Michael J. Sale, using authority delegated from the LIHI Governing Board, issued Preliminary Certification Decisions that the Rice Rips Hydroelectric Project (FERC No. P-2556), theUnion Gas Hydroelectric Project (FERC No. P-2556), and the Oakland Hydroelectric Project (FERC No. P-2556) all continue to satisfy the LIHI Certification Criteria.  These Certification Decisions include the following facility-specific conditions:

Oakland: Condition 1: On the Owner’s Annual Compliance Statements, the Owner will update LIHI on the status of upstream and downstream eel passage at the site. Unless determined to be impractical by DMR and the Owner, upstream passage shall be installed during the new certification period. The Owner will notify LIHI within 45 days when DMR determines there is a sufficient number of eel present in the river to conduct the studies needed to determine the best location to install downstream passage. A summary of those study results, along with a DMR approved plan and schedule for downstream eel passage installation, shall be included in that year’s Annual Compliance Statement.

Union Gas and Rice Rips: Condition 1: On the Owner’s Annual Compliance Statements, the Owner will update LIHI the status of downstream eel passage at the site. The Owner will notify LIHI within 45 days of when DMR determines there is a sufficient number of eel to present in the river to conduct the studies needed to determine the best location to install downstream passage. A summary of those study results, along with a DMR approved plan and schedule for downstream eel passage installation, shall be included in that year’s Annual Compliance Statement.

As required in Section 4.2.5 of the LIHI 2nd Edition Handbook, the Preliminary Certification Decision to certify, along with the Application Reviewer’s report and (if prepared) report of the Executive Director, was posted on the Institute’s Web page for 30 days.  Notice of the posting was provided to all individuals or organizations that commented on the initial Application Package, to provide an opportunity to appeal the decision. If an individual or organization did not comment on the initial Application Package, they were not permitted to request an appeal.  As no appeal was requested within the 30-day period, the LIHI Certification for all three facilities is now final.
